1. Agreement to Terms
These Terms of Use constitute a legally binding agreement between you, whether personally or on behalf of an entity (“you”), and RISE Executive Partners, LLC, doing business as The Founders Circle (“Company,” “we,” “us,” or “our”), concerning your access to and use of the https://riseexecutive.partners website and any related media forms or channels (collectively, the “Site”). By accessing the Site, you agree to be bound by these Terms of Use. If you do not agree with all of these Terms, you must discontinue use immediately. We reserve the right to make changes to these Terms at any time; continued use of the Site after changes are posted constitutes acceptance.
2. SMS / Text Messaging Terms & Conditions
Program. The Founders Circle sends program-related text messages (coaching call and session reminders, event and retreat logistics including dates, locations, and preparation details, and community updates) and, for members who opt in, occasional offers for our programs and events.
Opt-in. You consent to receive texts when you provide your mobile number during online enrollment, verbally during onboarding or coaching calls, or through a form on our website. Consent is not a condition of purchase.
Message frequency varies by program activity. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
Opt-out. Reply STOP to any message to cancel. You will receive a single confirmation text, after which no further messages will be sent.

Privacy. See our Privacy Policy at https://riseexecutive.partners/privacy-policy/. Mobile opt-in data and consent are never shared with third parties for marketing purposes.
3. Programs, Enrollment, and Payments
Program enrollment, community access, event tickets, and payments are processed through our community and scheduling platforms. Each enrollment or purchase is subject to the pricing, billing, and cancellation terms presented at the time of enrollment or stated in your membership or program agreement.
4. Educational Content — No Guarantees
Our coaching, courses, events, and community content are provided for educational and informational purposes only. We do not guarantee any particular business, financial, or personal result from participation in our programs; outcomes depend on factors within your control and outside of ours. Nothing on the Site or in our programs constitutes legal, tax, accounting, investment, or other professional advice, and you should consult qualified professionals before acting on any information we provide.
5. Retreats and In-Person Events
Our retreats and events may involve physical and outdoor activities. Participation may require a signed liability waiver and compliance with the safety rules of the venue or activity operator. Where an activity is delivered by a third-party venue or operator, that operator’s terms, waivers, and safety requirements apply to your participation, and the operator is responsible for the delivery and safety of the activity.
6. Intellectual Property and Program Materials
Unless otherwise indicated, the Site and our program materials — including course content, frameworks, workbooks, recordings, designs, text, photographs, video, and graphics (the “Content”) — along with the trademarks, service marks, and logos contained therein (the “Marks”), are owned or controlled by us or licensed to us and are protected by copyright, trademark, and other intellectual property laws. Program materials are licensed for your personal use as a participant only; they may not be copied, shared, distributed, resold, or used to create derivative works or competing programs without our express prior written permission.
7. Acceptable Use and Community Conduct
You may not access or use the Site for any purpose other than that for which we make it available. You agree not to: systematically retrieve data or content from the Site; circumvent or interfere with security-related features; harass, abuse, or harm another person, including other members of our community; upload or transmit viruses or other malicious material; engage in automated use of the system; attempt unauthorized access to the Site or its networks; or use the Site in any manner inconsistent with applicable laws or regulations. We may remove any member from our community spaces for conduct that violates these standards.
8. Reviews, Testimonials, and Submissions
If you post a review, testimonial, or feedback, you grant us a perpetual, non-exclusive, worldwide, royalty-free license to reproduce, display, and distribute that content. Reviews must reflect firsthand experience and may not contain offensive, false, or misleading statements. We may accept, reject, or remove reviews at our sole discretion.
9. Third-Party Websites and Content
The Site may contain links to third-party websites and content (including our community platform, scheduling tools, podcast, and social channels). We are not responsible for third-party websites or content, and inclusion of a link does not imply our endorsement. Purchases made through third-party websites are between you and the applicable third party.

We reserve the right, but not the obligation, to monitor the Site for violations of these Terms, restrict or disable access, and otherwise manage the Site in a manner designed to protect our rights and property and to facilitate its proper functioning. We may deny access to the Site to any person for any reason, at our sole discretion.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SITE AND YOUR USE THEREOF, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SITE’S CONTENT OR THE CONTENT OF ANY LINKED WEBSITES.
12. Limitation of Liability
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, OR LOSS OF DATA, ARISING FROM YOUR USE OF THE SITE OR OUR PROGRAMS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
13. Indemnification
You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of your use of the Site, your breach of these Terms, or your violation of the rights of a third party.
14. Electronic Communications
Visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing. You agree to the use of electronic signatures, contracts, orders, and other records.
15. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law principles. Any legal action shall be commenced or prosecuted in the state and federal courts located in Washington County, Utah, and the parties consent to the jurisdiction and venue of such courts.
16. Miscellaneous
These Terms and any policies posted on the Site constitute the entire agreement between you and us. Our failure to enforce any right or provision shall not operate as a waiver. If any provision is determined to be unlawful, void, or unenforceable, that provision is severable and does not affect the validity of the remaining provisions.
